These Terms of Service and Data Security Policy govern your use of our services, including the LastingMind website, application, and related tools (collectively, the "Services"). By subscribing to or using our Services, you agree to the terms outlined below.

By accessing or using LastingMind, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, please discontinue use of the Services.

2. Description of Services

LastingMind provides a platform that helps individuals capture, preserve, and share their personal stories, voice, likeness, and memories through AI-driven digital personas ("Avatars"). Our Services include but are not limited to:

• Guided interviews and questionnaires;
• AI-generated written, audio, and video content;
• Secure storage of voice, image, text, and video recordings;
• Conversational interactions with digital Avatars created by subscribers or their families.

Data collected may include personal narratives, media files, and chat interactions between users and Avatars. These may be accessed by authorized users based on account permissions.

3. Subscriber Responsibilities

Subscribers are responsible for the accuracy, security, and lawful use of all content uploaded to LastingMind.

3.1 Accuracy of Information

Subscribers are solely responsible for the accuracy of the content they upload or record. LastingMind does not verify or edit submitted data. Subscribers should review and test their Avatar responses before making them available to others.

3.2 Security of Credentials

Subscribers must maintain the confidentiality of their account credentials. Any activity occurring under a subscriber's account is their responsibility. Subscribers are also responsible for managing and approving who can access or interact with their Avatar.

3.3 Compliance with Laws

Subscribers must comply with all applicable privacy, copyright, and data protection laws. LastingMind is not liable for violations of such laws resulting from subscriber actions or content.

4. Data Collection, Privacy, and Security

By using our Services, you consent to the secure collection and storage of your data — including text, images, voice recordings, video, and any other content submitted for the creation or operation of your Avatar.

4.1 Data Security Practices

LastingMind uses Google Firebase and Google Cloud infrastructure to store and process user data. These services implement industry-standard security safeguards, including encryption in transit and at rest, access controls, and system monitoring. We take reasonable technical and organizational measures to protect user information from unauthorized access, misuse, or disclosure.

Access to user data is limited to authorized personnel and used only for purposes directly related to providing and improving the Services. While we strive to maintain high security standards, no online system can guarantee absolute security, and users provide information at their own discretion and risk.

5. Intellectual Property

All software, algorithms, trademarks, and proprietary technology are the exclusive property of LastingMind. Subscribers retain ownership of their uploaded materials and recorded likenesses but grant LastingMind a limited license to use them solely for providing and improving the Services.

6. Termination of Service

LastingMind reserves the right to suspend or terminate access at any time, with or without cause, including for violations of these Terms or suspected misuse of the platform.

7. Disclaimer of Warranties

Our Services are provided "as is" and "as available." LastingMind makes no warranties regarding the accuracy or completeness of Avatar responses, continuous service, or suitability of content for any specific purpose.

8. Limitation of Liability

LastingMind is not liable for any direct, indirect, incidental, or consequential damages arising from use or inability to use the Services, loss or corruption of data, or unauthorized access to your content.

9. AI Chat and Avatar Interaction Disclaimer

Avatars and chat responses are generated using AI based on the information provided by subscribers. The content is for informational and storytelling purposes only and should not be interpreted as factual statements, advice, or representations of living persons.

9.1 No Professional Advice

Avatars and chat interactions do not provide medical, legal, financial, or professional advice. Users should seek qualified professionals for such matters.

9.2 User Conduct

Users are prohibited from engaging in abusive, harassing, or illegal interactions with Avatars or other users. LastingMind reserves the right to restrict access to protect the integrity of the platform.

9.3 Intellectual Property

Avatars created within the platform remain under the subscriber's ownership. However, LastingMind retains the right to store and use anonymized versions of interaction data to improve AI models.

9.4 Indemnification

By using LastingMind, you agree to indemnify and hold harmless LastingMind, its affiliates, and the creators of Avatars from any claims, damages, or liabilities resulting from your use of the Services or violations of these terms.

10. Changes to Terms

LastingMind reserves the right to update or modify these Terms at any time. Updates will take effect immediately upon posting. Continued use of the Services constitutes acceptance of revised terms.
